Welcome to AirDeelay.com. Please read these Terms and Conditions ("Terms") carefully before using our services. By submitting a claim through our website, you agree to be bound by these Terms.
1. DEFINITIONS
In these Terms, the following definitions apply:
- "Company", "We", "Us": Refers to BETA STONE HOLDINGS LIMITED, a company registered in Cyprus (Registration Number HE374184), with its registered office at Ευαγόρα Παλληκαρίδη, 2, 3035, Λεμεσός, Κύπρος.
- "Client", "You": Any person who has accepted these Terms and submitted a claim for flight compensation.
- "Regulation": Regulation (EC) No 261/2004 of the European Parliament and of the Council establishing common rules on compensation and assistance to passengers.
- "Compensation": The total amount of money paid by the airline in relation to the Client’s claim, including flight compensation, refund of tickets, or reimbursement of expenses.
- "Service": The service provided by AirDeelay.com to pursue the Client's claim against the airline, including extra-judicial and judicial measures.
2. THE AGREEMENT
2.1. By submitting a claim form on AirDeelay.com, you warrant that you have the legal capacity to enter into a contract.
2.2. You warrant that the data provided is accurate, complete, and true.
2.3. By signing the Power of Attorney (Assignment Form), you grant us the authority to represent you in communications with the airline and legal bodies.
2.4. You agree not to appoint any other party to pursue the same claim or pursue it yourself directly while this agreement is in effect.
3. DESCRIPTION OF SERVICE
3.1. AirDeelay.com will assess the eligibility of your claim using flight data and legal expertise.
3.2. If the claim is deemed valid, we will formally contact the airline to request Compensation.
3.3. If the airline refuses to pay, we may, at our discretion, initiate legal action through our network of legal partners. You will not be charged extra for this legal action; all costs are covered by us.
3.4. We act on a "No Win, No Fee" basis. If we do not recover Compensation, you owe us nothing.
4. FEES AND PAYMENTS
4.1. No Upfront Fee: Submitting a claim is completely free of charge.
4.2. Service Fee: If we successfully recover Compensation, we are entitled to a Service Fee of 20% of the total Compensation amount.
4.3. VAT: Value Added Tax (VAT) is applicable to the Service Fee in accordance with Cyprus law. The current applicable VAT rate is 23%.
4.4. Calculation Example:
If the flight compensation is €600:
- Service Fee (20%): €120.00
- VAT on Service Fee (23%): €27.60
- Total Deduction: €147.60
- Client Receives: €452.40
4.5. The Compensation will be received into the Company's bank account. We will deduct the agreed Service Fee and VAT, then transfer the remaining balance to the bank account provided by you.
4.6. All bank transfer fees charged by our bank are covered by us. Any fees charged by your bank or intermediary banks are your responsibility.
5. CLIENT OBLIGATIONS
5.1. You must provide all documents required to process the claim (e.g., boarding pass, booking confirmation, ID) promptly.
5.2. If the airline contacts you directly offering a settlement (e.g., vouchers or cash), you must inform us immediately. If you accept a direct payment from the airline after engaging our services, you are still liable to pay our Service Fee.
5.3. You must not provide false or misleading information. If you knowingly provide false data, we reserve the right to terminate the agreement and claim reasonable costs.
6. WITHDRAWAL AND TERMINATION
6.1. You have the right to withdraw from this agreement within 14 days of submission without giving any reason, provided that the airline has not yet accepted the claim or paid the Compensation.
6.2. To exercise the right of withdrawal, you must notify us via email at contact@airdeelay.com.
6.3. We reserve the right to terminate the agreement if we determine that the claim lacks sufficient legal merit or likelihood of success.
7. DATA PROTECTION
7.1. We process your personal data in accordance with the GDPR and our Privacy Policy.
7.2. By using our service, you consent to the processing of your data for the purpose of the claim, including sharing it with airlines, legal partners, and courts where necessary.
8. LIMITATION OF LIABILITY
8.1. We are not liable for any loss of value of the compensation due to currency fluctuations or bank fees charged by the Client's bank.
8.2. Our liability is limited to the amount of the Compensation recovered.
9. GOVERNING LAW AND JURISDICTION
9.1. These Terms are governed by the laws of the Republic of Cyprus.
9.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus.
